Definitions

The terms used in the Regulations shall mean:
1.1 Customer – a natural person, a legal person or an organizational unit that is not a legal person, which is specifically granted legal capacity by the regulations, who makes an Order from the Store;
1.2 Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended);
1.3 Rules and Regulations – these Rules and Regulations for the provision of electronic services within the online store www.bakeplus.pl.
1.4 Online Store (Store) – Internet service available at www.bakeplus.pl, through which the Customer may, in particular, place orders;
1.5 Goods – products presented in the Online Store;
1.6 Contract of Sale – agreement for the sale of Goods within the meaning of the Civil Code, concluded between Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. and the Client, concluded with the use of the Shop’s website;
1.7 Consumer Rights Act – the Act of May 30, 2014. (Journal of Laws No. 2014, item 827);
1.8 Act on Provision of Electronic Services – the Act of July 18, 2002 on Provision of Electronic Services ( Journal of Laws No. 144, Item 1204 as amended);
1.9 Order – the Customer’s declaration of will, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of goods;

II. General provisions

2.1 These Regulations define the rules for the use of the online store available at www.bakeplus.pl;
2.2 These Regulations are the regulations referred to in Article 8 of the Electronic Services Act;
2.3 The online store available at www.bakeplus.pl is run by Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. , ul. Spółdzielcza 3A, 37-415 Zaleszany, NIP 602-004-86-80, REGON 180931871.

2.4 These regulations specify in particular
a) rules for registration and use of an account within the online store;
b) terms and conditions for placing electronic Orders within the online store;
2.5 The use of the online store is possible provided that the ICT system used by the Customer and the following minimum technical requirements are met:
(a) optional web browsers: Internet Explorer, Firefox, Mozilla, Google Chrome, Opera, Safari.
b) minimum screen resolution of 1024×768
2.6 In order to use the online store, the customer should on his own access to a computer workstation or terminal device, with Internet access;
2.7 In accordance with the applicable legal regulations Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. running the www.bakeplus.pl store reserves the right to limit the provision of services via the Online Shop to persons under 18 years of age. In such case, potential Customers will be notified of the above;
2.8 Customers may access these Terms and Conditions at any time through the link provided on the home page of www.bakeplus.pl and download and print them;
2.9 Information about goods provided on the Store’s websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code;

III. Rules of using the Online Store

3.1 A prerequisite for using the Online Store is registration with it;
3.2 Registration takes place by completing and accepting a registration form, made available on one of the pages of the Store;
3.3 Registration is conditional on agreeing to the content of the Terms and Conditions and providing personal data marked with an asterisk as mandatory;
3.4 The Customer, during the registration process or later, may agree by ticking [ ] box “I agree to receive the newsletter in the future” to be sent commercial information electronically by Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. seated in Stalowa Wola in accordance with the Act of 18 July 2002 on provision of services by electronic means (Journal of Laws 2002 No. 144, item 1204 as amended) from which he may resign at any time;
3.5 Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. may deprive the Customer of the right to use the Online Shop, as well as limit his/her access to a part or all resources of the Online Shop, with immediate effect, in case of violation of these Terms and Conditions by the Customer, and in particular when the Customer:
a) provided during registration in the Internet store data that is untrue, inaccurate or outdated, misleading or violating the rights of third parties;
b) committed, through the online store, a violation of the personal rights of third parties, in particular the personal rights of other customers of the online store;
c) engaged in other behavior which will be considered by Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. as inconsistent with applicable laws or general principles of Internet use, or harming the good name of Bakeplus Polska G.Jagiełło i M.Sądej Sp.J.;
3.6 A person who has been deprived of the right to use the online store may not register again without prior consent of Bakeplus Polska G.Jagiełło i M.Sądej Sp.J.
3.7 In order to ensure the security of transmission of messages and data in connection with services provided on the Site, the Online Store shall take technical and organizational measures appropriate to the degree of security threat to services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet;
3.8 In particular, the Customer shall:
(a) not to provide or transmit content prohibited by law, such as content that promotes violence, defamatory or violates the personal rights and other rights of third parties;
b) use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices;
c) not to take actions such as: sending or posting unsolicited commercial information (spam) within the Internet store;
d) use the Online Shop in a manner which is not onerous for other clients and for Bakeplus Polska G.Jagiełło i M.Sądej Sp.J.;
e) use any content posted within the online store only for his/her own personal use;
f) use the online store in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, provisions of the Regulations, as well as with general principles of Internet use;

IV. Procedure for the conclusion of a sales contract and order execution

4.1 In order to conclude a contract of sale through the Online Store, it is necessary to enter the website www.bakeplus.pl, make a selection of goods, their brand, color and size, taking subsequent technical actions based on the messages displayed to the customer and information available on the website;
4.2 Customer’s selection of the ordered Goods is made by adding them to the shopping cart;
4.3 In the course of placing the Order – until pressing the “Place Order” button – the Customer has the possibility of modifying the entered data and in the selection of the Goods. In order to do so, it is necessary to follow the messages displayed to the Customer and the information available on the site;
4.4 After the Customer using the Online Store has provided all the necessary data, a summary of the placed order will be displayed. The summary of the placed order will include information regarding:
(a) the subject of the order,
b) unit and total price of the ordered products and delivery costs,
c) the selected method of payment,
d) the selected method of delivery,
e) delivery time
4.5 In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button “Order, to pay”;
4.6 Sending an Order by the Customer constitutes a declaration of will to conclude with Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. Sales Agreement, in accordance with the content of the Regulations;
4.7 After placing an Order, the Customer receives an e-mail message entitled: “Confirmation of Order Receipt”, containing final confirmation of all significant elements of the Order;
4.8 The Contract shall be considered concluded from the moment the Customer receives the e-mail message referred to above and confirms the purchase by the Customer through the “Confirm Order Placement” button;
4.9 The Contract of Sale shall be concluded in the Polish language, with contents in accordance with the Terms and Conditions.

V. Acquisition of goods as part of intra-Community supply of goods within the EU for VAT taxpayers identified for the purposes of intra-Community transactions

5.1 When is an activity/transaction considered an intra-Community supply of goods? An activity is considered an intra-Community supply of goods when all of the following conditions are met:

(a) the goods will be exported from the territory of the country, understood as the territory of the Republic of Poland, and it takes place in order to perform the activities specified in Article 7 of the VAT Act in the territory of a Member State other than the territory of Poland;
b) the transaction is made to a counterparty who is a VAT taxpayer identified for the purposes of intra-Community transactions in the territory of the EU;
5.2 Who is the counterparty of intra-Community transactions?
The counterparty is a VAT taxpayer identified for the purposes of intra-Community transactions within the EU (i.e., has a valid EU VAT number) or is a legal or natural person that is not a VAT taxpayer and is identified for the purposes of intra-Community transactions within the EU (i.e., has a valid EU VAT number);
5.3 In order to make an intra-Community delivery of goods in our store, please select “Company” in the ordering data, choose the destination country of delivery, and select the options “I am an EU VAT payer. I order without VAT and undertake to settle it within my country”.
After positive verification of the contractor’s data including the EU VAT number, we will issue you an invoice with 0 VAT rate in accordance with the regulations;

VI. Delivery

6.1 Delivery of the Goods shall be made to the individual countries and to the address indicated by the customer when placing the order;
6.2 Delivery of the ordered Goods shall be made via the Polish Post, courier company and logistics operator “Paczkomaty InPost” only within the territory of the Republic of Poland. Delivery costs are. Outside the Polish borders the delivery is carried out through a courier company;
6.3 The delivery period is from 3 to 5 working days counting from the day the Customer sends the Order. Delivery of foreign shipments is from 7 to 10 working days;
6.4 Customers may access these terms and conditions at any time through the link provided on the home page of www.bakeplus.pl and download and take a printout of them.
Recording, securing, making available and confirming to the Customer the important provisions of the Sales Agreement of Goods shall be done by sending to the Customer at the e-mail address provided and by attaching to the shipment, a fiscal receipt or a VAT invoice (at the Customer’s request);

VII. Prices and payment methods

7.1 The prices of the Goods shall be quoted in Polish zloty and shall include all components, including VAT (distinguished by the rate), customs duties and any other components;
7.2 The Customer at the option of paying the price:
(a) by bank transfer to the bank account number:……………………………………………………………………………………….
b) payment in Przelewy24, PayU, Paypal system
c) payment in the system E-Raty Żagiel
d) payment by Pol Card, Visa Mastercard. The credit card is charged the day after the order is placed.
7.3 Orders with cash on delivery payment option are possible to place only up to the amount of maximum 1000 PLN. Orders for amounts exceeding the threshold of 1000 PLN are processed only with prepayment option.

VIII. Right to withdraw from the contract

You have the right to withdraw from this contract within 14 days without giving any reason.
The term of withdrawal expires after 14 days from the day on which you took possession of the item or on which a third party other than the carrier and indicated by you took possession of the item.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).

You may use the model withdrawal form, but it is not mandatory. You can also fill out and send the withdrawal form or any other unambiguous statement by e-mail www.bakeplus.pl. If you use this option, we will promptly send you an acknowledgement of receipt of the withdrawal information on a durable medium (by e-mail).
In order to observe the withdrawal period, it is sufficient for you to send the information concerning the exercise of your right of withdrawal before the expiry of the withdrawal period.

Effects of withdrawal from the contract
In the event of withdrawal from this contract, we will return all payments received from you, immediately and in any case no later than 14 days from the day we are informed about your decision to exercise your right of withdrawal from this contract. We may withhold reimbursement until we receive the item or until you provide us with proof of its return, whichever event occurs first.
Please send back or give us the item to the following address: Bakeplus Polska G.Jagiełło i M.Sądej Sp.J., Ul. Targowa 16, 37-464 Stalowa Wola immediately, and in any case no later than 14 days from the day on which you informed us about withdrawal from this contract. The deadline is met if you send the item back before the expiry of the 14-day period.
You will have to bear the direct costs of returning the item.

IX. Complaints about Goods

9.1 Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. as a seller is liable to the Customer who is a consumer within the meaning of Article 221 of the Civil Code, under warranty for defects in the range specified in the Civil Code;
9.2 Complaints arising from violation of Customer’s rights guaranteed by law or under these Terms and Conditions should be addressed to: www.bakeplus.pl. Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered;
9.3 Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. is not a manufacturer of goods. The manufacturer is liable under the warranty of the sold Goods under the conditions and for the period indicated in the warranty card. If the warranty document provides for such possibility, the Customer may submit his/her claims under the warranty directly to the authorized service center, the address of which is indicated in the warranty card;

X. Complaints regarding the provision of electronic services.

10.1 Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. undertakes actions in order to ensure fully correct functioning of the Shop to the extent resulting from the current technical knowledge and undertakes to remove all irregularities reported by the Customers within a reasonable time;
10.2 The Customer is obliged to immediately notify Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. of any irregularities or interruptions in functioning of the Online Shop service;
10.3 Irregularities related to the functioning of the Shop, the Customer may report them in writing to the following address: Bakeplus Polska G.Jagiełło i M.Sądej Sp.J.

10.4 In a complaint, the Customer should provide his/her name and surname, mailing address, type and date of occurrence of an irregularity related to the functioning of the Store;
10.5 Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered;

XI. Final provisions

11.1 Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. is the owner of all product photos, graphics, logos and holds full copyright to them. Bakeplus Polska G.Jagiełło i M.Sądej Sp.J. also has the appropriate licenses to use the photos used to create advertising banners. Copying, altering, sharing and publishing them, as well as using them for sales purposes is prohibited and may result in criminal sanctions. Bakeplus Poland G.Jagiełło and M.Sądej Sp.J. does not allow their use, distribution and dissemination without the knowledge and written consent under pain of claims of copyright infringement and committing theft of intellectual property;
11.2 Settlement of potential disputes arising between Bakeplus Polska G.Jagiełło and M.Sądej Sp.J. and the Customer, who is a consumer within the meaning of Article 221 of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Civil Procedure Code.
11.3 Settlement of potential disputes arising between Bakeplus Polska G.Jagiełło and M.Sądej Sp.J. conducting an online store and the Customer, who is not a consumer within the meaning of Article 221 of the Civil Code, is subject to the courts having jurisdiction over the seat of Bakeplus Polska G.Jagiełło and M.Sądej Sp.J;
11.4 Matters not covered by these Terms and Conditions shall be governed by the provisions of the Civil Code, the provisions of the Act on Electronic Service Provision and other relevant provisions of Polish law;
